Sections 521-525 of the CLEAN Future Act lay out the Federal Buy Clean program. A federal Buy Clean program has been introduced twice previously: first, <\/span><a href=\"https:\/\/www.congress.gov\/bill\/116th-congress\/senate-bill\/1864\"><span style=\"font-weight: 400\">by Senator Klobuchar in 2019<\/span><\/a><span style=\"font-weight: 400\"> and again in the <\/span><a href=\"https:\/\/energycommerce.house.gov\/newsroom\/press-releases\/ec-leaders-release-framework-of-the-clean-future-act-a-bold-new-plan-to\"><span style=\"font-weight: 400\">first draft of the CLEAN Future Act<\/span><\/a><span style=\"font-weight: 400\"> released in 2020.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The bill is described below using the framework outlined in the previous section:\u00a0\u00a0<\/span><\/p>\n<h3>Scope<\/h3>\n<p><span style=\"font-weight: 400\">Federal Buy Clean would apply to building materials purchased on projects involving Federal funds, to be specified in more detail by the Administrator, the Environmental Protection Agency (EPA), and coordinating agencies. This means that federally funded infrastructure projects, even if only partially funded by Federal funds like State projects, could be eligible.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The transparency program would begin with aluminum, iron, steel, concrete, and cement and expand to a secondary list including flat glass, insulation, unit masonry, and wood products. The program allows for the addition (or exclusion) of materials by the EPA or through public petition.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.16&#8243; global_colors_info=&#8221;{}&#8221;][et_pb_text _builder_version=&#8221;4.16&#8243; text_text_color=&#8221;#ffffff&#8221; text_font_size=&#8221;18px&#8221; text_line_height=&#8221;1.6em&#8221; background_color=&#8221;#0075a9&#8243; global_colors_info=&#8221;{}&#8221;]<\/p>\n<p>The CLEAN Act sets a goal of <span style=\"font-weight: 400\">achieving net zero greenhouse gas pollution no later than 2050, with an interim target of reducing pollution by 50 percent from 2005 levels no later than 2030.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row column_structure=&#8221;1_2,1_2&#8243; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text admin_label=&#8221;Disclosure&#8221; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Disclosure<\/h3>\n<p><span style=\"font-weight: 400\">Section 522, Embodied Emissions Transparency, would build on the progress from the private sector in the use of <\/span><span style=\"font-weight: 400\">environmental product declarations (EPDs)<\/span><span style=\"font-weight: 400\"> by requiring the EPA, in consultation with the Secretary of Energy, the Director of the National Institute of Standards and Technology, and relevant National Laboratories to \u201cestablish a program to enhance the transparency, quality, and availability of life-cycle assessment data\u201d by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Designating a product category rule\u2014either developed by a third party or newly developed by the EPA\u2014for each eligible material (Section 522c);\u00a0<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Establishing a National EPD Database to provide a publicly accessible database of EPDs that conform to the designated PCRs; and<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Requiring the EPA to evaluate EPDs and recommend opportunities for harmonization or improvement.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Harmonizing the development and reporting of life cycle assessment (LCA) data is a role that has been taken on by federal governments in Europe, such as through Germany\u2019s <\/span><a href=\"https:\/\/www.oekobaudat.de\/en.html\"><span style=\"font-weight: 400\">\u00d6K\u00d6BAUDAT<\/span><\/a><span style=\"font-weight: 400\"> database and France\u2019s <\/span><a href=\"https:\/\/www.inies.fr\/home\/\"><span style=\"font-weight: 400\">INIES database<\/span><\/a><span style=\"font-weight: 400\">.<\/span><\/p>\n<p>[\/et_pb_text][\/et_pb_column][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text admin_label=&#8221;EPD definition&#8221; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Environmental Product Declaration (EPD)<\/h3>\n<p>The CLEAN Future Act defines an EPD as a document that includes a product-specific measurement of the embodied emissions of a product on a mass basis and per functional unit that:<\/p>\n<ul>\n<li>is in accordance with international standards, such as a Type III EPD, as defined by ISO 14025<\/li>\n<li>is calculated for a specific facility; communicates transparent and comparable information<\/li>\n<li>includes all stages of manufacturing required by the product<\/li>\n<li>is verified by an independent third party<\/li>\n<li>is developed in accordance with the criteria specified in the appropriate PCR designated by the EPA<\/li>\n<li>is valid for no more than 5 years<\/li>\n<\/ul>\n<p>[\/et_pb_text][\/et_pb_column][\/et_pb_row][et_pb_row column_structure=&#8221;1_2,1_2&#8243; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_column type=&#8221;1_2&#8243; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;][et_pb_text admin_label=&#8221;Standards Incentives Compliance&#8221; _builder_version=&#8221;4.16&#8243; _module_preset=&#8221;default&#8221; global_colors_info=&#8221;{}&#8221;]<\/p>\n<h3>Standards<\/h3>\n<p><span style=\"font-weight: 400\">Section 524 would require the EPA and Secretary of Energy to establish a Buy Clean program in coordination with <\/span><span style=\"font-weight: 400\">relevant Federal agencies.<\/span><span style=\"font-weight: 400\"> Buy Clean programs typically require that eligible materials used on public infrastructure projects be required to submit EPDs that demonstrate that a product meets a performance standard set by the program. Standards are typically maximum global warming potential (GWP) limits measured in kilograms of carbon dioxide equivalent per unit, as calculated through a life cycle assessment. The involved agencies would determine how GWP limits are developed, the materials that must meet these limits, the implementation timeline, and other details of the program.<\/span><\/p>\n<h3>Incentives<\/h3>\n<p><span style=\"font-weight: 400\">The bill includes two types of incentive programs. First, Section 522 establishes support for manufacturers by:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Creating a technical assistance program for manufacturers of eligible materials to help them develop and verify EPDs;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Creating a grant program for small businesses to develop EPDs; and<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">Requiring public outreach and education to manufacturers to encourage them to submit EPDs to the national database.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400\">Second, Section 525 establishes a Climate Star program, which is similar to the existing Energy Star program in that there will be a Climate Star label that indicates products meet low-carbon performance criteria.\u00a0 This would enable Climate Star products to be promoted in federal procurement policies and catalogs of products, creating an additional incentive for manufacturers to manufacture low-carbon products.<\/span><\/p>\n<h3>Compliance<\/h3>\n<p><span style=\"font-weight: 400\">The bill requires that development of the Buy Clean program begins within a year of enactment, but does not specify a specific timeline by which eligible materials must meet performance standards. The advice letter was developed between February 2020 and September 2020 by GBAC\u2019s Embodied Energy Task Group (EETG), which collected policy recommendations from the Carbon Leadership Forum, RMI, and others.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The approved letter outlines the environmental, economic, human health, and social justice benefits for reducing industrial greenhouse gas emissions and asserts that the benefits of reducing embodied energy and carbon in the GSA\u2019s construction portfolio could be achieved with \u201clittle to no additional cost [to the GSA] beyond a minimal amount of administrative time\u201d while encouraging a market shift towards lower-energy and lower-carbon materials.<\/span><\/p>\n<p><span style=\"font-weight: 400\">The policy recommendations outlined in the letter were intentionally aligned with existing federal policy and systems.\u00a0 This makes it relatively easy for the GSA to expand its current procurement standards (<\/span><a href=\"https:\/\/www.gsa.gov\/real-estate\/design-construction\/engineering-and-architecture\/facilities-standards-p100-overview\"><i><span style=\"font-weight: 400\">Facilities Standards for Public Buildings Service (P100)<\/span><\/i><\/a><i><span style=\"font-weight: 400\">) <\/span><\/i><span style=\"font-weight: 400\">to include embodied carbon because the recommendations would be similar to existing environmental policies on energy targets, accessibility, or waste diversion.\u00a0 <\/span><span style=\"font-weight: 400\">The letter is unique in that it recommends both material-scale and building-scale approaches.<\/span><\/p>\n<p><b>Part 1: Material approach<\/b> <i><span style=\"font-weight: 400\">(applies to all projects, including tenant improvements)<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400\">The material-scale approach would require contractors to collect a third party\u2013certified, product-specific EPDs for 75% of new eligible materials (estimated by dollar value or weight) on all projects.\u00a0 These EPDs must demonstrate that the global warming potential (GWP) of the material installed is in the best-performing 80% of functionally-equivalent products based on data from a publicly-available EPD database.\u00a0 The letter contains additional recommendations that encourage material salvage, reuse, and use of materials manufactured in plants with an ENERGY STAR score of 50 or higher.<\/span><\/p>\n<p><b>Part 2: Building approach<\/b> <i><span style=\"font-weight: 400\">(applies to prospectus-level<\/span><\/i><i><span style=\"font-weight: 400\"> projects)<\/span><\/i><\/p>\n<p><span style=\"font-weight: 400\">The building-scale approach would require the project team to design a building in such a way that results in a 20% reduction of GWP compared to a baseline building, per the requirements defined in LEED v4.1\u2019s Building Life-Cycle Impact Reduction credit or the Green Globes Assessment Protocol for Commercial Buildings. The program provides educational resources aimed at providing technical assistance to transportation agencies, who are key to reducing the approximately 12% of annual US embodied carbon attributed to highway and street construction (see <\/span><a href=\"https:\/\/carbonleadershipforum.org\/what-is-a-buy-clean-policy\/\"><span style=\"font-weight: 400\">What is a Buy Clean policy<\/span><\/a><span style=\"font-weight: 400\">).<\/span><\/p>\n<p><b>Executive orders<\/b><\/p>\n<p><span style=\"font-weight: 400\">The Executive branch does not require legislative action to change procurement policy to tie sustainability requirements to infrastructure spending. The healthcare sector is supported by the research and development activities of the National Institutes of Health, with an annual budget of $42 billion, or 5,000% of what we spend on the industrial sector.&#8221;<\/span><\/p>\n<\/blockquote>\n<p><a href=\"https:\/\/docs.house.gov\/meetings\/IF\/IF18\/20210318\/111348\/HHRG-117-IF18-Wstate-DellR-20210318.pdf\"><span style=\"font-weight: 400\">Dell\u2019s testimony<\/span><\/a><span style=\"font-weight: 400\"> states that a majority of current funding is through the <\/span><a href=\"https:\/\/www.energy.gov\/eere\/amo\/advanced-manufacturing-office\"><span style=\"font-weight: 400\">DOE\u2019s Advanced Manufacturing Office<\/span><\/a><span style=\"font-weight: 400\">, a subdivision of DOE\u2019s Office of Energy Efficiency &amp; Renewable Energy.\u00a0 It supports R&amp;D and technical partnerships focused on new manufacturing technologies.
